Electronic Documents Circulation in the Context of Electronic Commerce

10.10.2010 In the latest issue of "The Legal Newspaper" of October 5, 2010 an article of the partner of the Law Firm “Moskalenko & Partners” Julia Kondratska titled "Electronic Documents Circulation in the Context of Electronic Commerce" was published. The author analyzes trends in the development of domestic legislation in the relevant field and concludes that the Ukrainian business is unable to take advantages of the e-commerce tools. The main reason is that for the time being subordinate legislation has not been developed in pursuance of the provisions of the laws and the existing provisions are not adapted to the legal relations between subjects of electronic commerce and consumers. As a consequence - online retailers are forced to use conventional methods of documenting - that is in paper form. The author proposes to implement into domestic legislation a number of innovations that are designed to give impetus to the development of electronic commerce in Ukraine. Among the most significant innovations is the adoption of the Informational Code.
